    1. This website is operated by REMARQUÉ (ABN 75 174 379 159). When we say “we”, “us” or “our”, we mean REMARQUÉ. The term ‘you’ or ‘customer’ refers to the user or viewer of our Website or the person buying or requesting products from REMARQUÉ.

    2. By browsing or purchasing from our site, you agree to these Terms & Conditions, along with any related policies referred to or linked here or mentioned throughout our website.

    3. We may update these Terms & Conditions from time to time. We’ll always aim to be transparent about any changes, and continued use of our website means you accept the updated terms.

    4. Our store is proudly hosted by Shopify Inc., a trusted and secure ecommerce platform.

 


 

  1. Eligibility & Use

    1. To shop with us, you must be at least the age of majority in your state/ country or have permission from a parent or guardian.

    2. We ask that you use our site responsibly and respectfully — following all relevant laws and never misusing the service for harmful purposes.

All intellectual property rights in the content available on or through this Website are owned by REMARQUÉ or its licensors and are protected under applicable copyright legislation and international conventions. All such rights are expressly reserved. You may retain, print, or display content solely for your personal, non-commercial use. Any unauthorised reproduction, adaptation, or use of such materials for commercial or public purposes is prohibited. 

    2. The sharing of our published social media content is permitted only through the platform’s authorised “share” function or with our prior written consent.


  1.  Orders, Payment & Billing

    1. When placing an order, you agree to provide accurate and up-to-date details.

    2. We reserve the right to refuse or cancel an order if we suspect misuse, fraud, or breach of our Terms & Conditions.

    3. All payments are processed securely via Shopify or trusted payment partners— We do not store any credit card or banking information.

    4. By selecting Afterpay as your payment method, you acknowledge and agree to the terms of the Credit Contract between you and Afterpay, as well as all applicable Afterpay General and Specific Terms.(Add links to pages). All Afterpay orders are subject to Afterpay’s approval.

    5. International customer orders may incur customs duties, VAT, or other import taxes/fees upon delivery. As these fees vary by country, they are excluded from our prices and are to be paid by the customer.

    6. Store credits will expire 3 years from the date of issue.

 


 

  1. Product Descriptions & Pricing

    1. Prices listed are in AUD and include GST (if applicable).

    2. We do our best to ensure all product descriptions, images, prices and product availability are accurate and up to date. However, occasional errors may occur — and we reserve the right to correct them.

    3. We strive to represent our pieces as faithfully as possible. Despite efforts for accuracy, actual product colours may vary slightly and some items may appear slightly smaller or larger due to screen settings, lighting and photography techniques.

    4. Prices, product availability and product descriptions may change at our discretion.

 


 

  1. Shipping & Delivery

    1. All orders are shipped from Melbourne, Australia and are typically dispatched within 3 business days, with exceptions for pre-orders or backordered items.

    2. All shipping timeframes shown at checkout are provided as estimates and may be affected by external factors (customs, couriers, etc.) which are beyond our control. While we strive to ensure timely delivery, we cannot accept responsibility for delays caused by these circumstances.

    3. Please ensure your shipping details are correct when placing an order. We’ll do our best to assist with changes if notified promptly, but cannot guarantee corrections. In the event a parcel is undeliverable because of an incorrect address, delays or additional fees may apply, and these would be the customer’s responsibility.

    4. If you’re ordering from outside Australia, shipments may incur customs duties, VAT, or other import taxes upon delivery. As these fees vary by country, they are excluded from our prices and are to be paid by the customer.

    5. As we only offer ‘Signature on Delivery’, in cases of missed delivery, you may be required to collect the parcel from a local depot within the required timeframe.

 


 


  1. Returns & Refunds

    1. Items purchased on sale are final sale and not eligible for return.

    2. For hygiene reasons, any purchases on earrings are strictly final sale and cannot be returned.

    3. All return/ refund requests are to be submitted only via emailing shop@remarque.au.

    4. Non-sale items to be returned or refunded are only eligible if they are deemed to be:

      1. Unworn

      2. In their original condition (undamaged)

      3. In their original packaging (undamaged)

      4. Accompanied by proof of purchase and completed Returns Form

      5. Within 30 days from delivery date

    5. Eligible change of mind returns on full-priced items will be offered a store credit.

    6. All return requests must include:

      1. 2–3 clear images of the item (including fault/issue if warranty claim)

      2. A detailed description of the fault/issue (warranty claim only)

      3. Emailed invoice receipt 

      4. Order number

      5. Completed Returns Form when provided by us

    7. Warranty claims may not be approved until after we have received them for assessment.

    8. If we have sent out the incorrect item/size, the customer is required to notify us within 30 days of delivery. All conditions listed in 7.4 must be met to be eligible for return.

    9. Accepted returns for incorrectly sent and DOA items will be remedied by replacement or store credit if the item is out of stock. Return shipping costs for incorrectly sent and DOA items will be reimbursed via the customers original payment method once the item is received by us. 

    10. Customers are responsible for organising return postage. All returns must include a completed Returns Form and be packaged securely. For safety and reliable delivery, returns are required to be sent to us via Australia Post Tracked Mail. 

    11. Customers are required to retain and provide proof of postage/delivery using Australia Post tracked mail for verification.

    12. We do not take responsibility for any parcels that are lost or damaged in transit on return to us.

    13. We do not cover or refund any fees/ taxes/ duties related to International returns. 

    14. International change-of-mind returns will be refunded or credited for the items’ paid value only, with shipping costs and any applicable duties or fees deducted.

    15. If your purchase included a Gift With Purchase (GWP) it may be required that the GWP item is to be returned with your refund request. If the GWP is not returned, the value of the gift may be deducted from the refund issued. Discretion will be used on a case by case basis.

    16. Refunds and store credits are in AUD and include GST (if applicable).

    17. Afterpay returns will be processed in accordance with the Afterpay General and Specific Terms of service. (See 4.4 for links)

  1. Warranty & Faulty Pieces

    1. All REMARQUÉ jewellery is covered by a 6-month limited warranty for manufacturing faults and defects.

    2. Warranty period begins from the date of delivery. 

    3. Manufacturing defects are defects that are not caused by normal wear or misuse (e.g. clasp won’t close, stone set poorly, etc). This includes items defective on arrival (DOA). Items are deemed DOA if they are delivered with visible defects and/ or unwearable (e.g. broken, scratched, missing stone, etc).

    4. Warranty claims are eligible if they are deemed to be:

      1. Within the 6-month warranty period

      2. Not caused by misuse or improper care

    5. The warranty does not cover:

      1. Normal wear and tear

      2. Tarnishing or fading from improper care, storage or contact with chemicals

      3. Accidental damage (e.g. drops, knocks, water exposure)

      4. Lost items

      5. Damage caused by a third-party jeweller/ external party

      6. GWP items

    6. Warranty coverage is void once and if the item has been modified or repaired by any third-party jeweller or external party

    7. Accepted warranty claims are remedied by one of the following options:

      1. free repair

      2. free replacement

      3. 120% store credit based on the original purchase price 

    8. If an item has been delivered DOA, customers must let us know within 30-days of delivery and we will send out a replacement once we have received and assessed it as DOA. We will provide a like-for-like replacement or 120% store credit depending on stock availability.

    9. If an item is claimed as DOA due to defects including but not limited to chips or scratches but is found to show signs of wear, we reserve the right to decline the warranty claim, as the damage may have occurred after the item was worn.

    10. We may request the item be returned for further assessment before accepted under warranty.

 


 

  1. Promotions & Sale Items 

    1. Only one discount code can be used per order.

    2. Discount codes are valid for full-priced items only, unless stated otherwise.

    3. Discounts, promotions and loyalty offers cannot be combined.

    4. Sale items and promotional items are final sale and not eligible for return unless a major defect on DOA. 

    5. Gift With Purchase (GWP) must be returned in its original/ unused condition if the main item/ attached item in an order is returned/ refunded for change-of-mind. Discretion is used for orders with multiple items. Change-of-mind return requests for single item orders are always required to return the GWP. If the GWP is not returned when required, the full cost of the gift will be deducted from the refund amount

    6. All promotional terms are subject to change and apply while stock lasts.

 


 

  1. User Content & Social Media

    1. By tagging @remarque.au or using a hashtag promoted by REMARQUÉ, you grant us permission to re-share, reproduce, or otherwise use the associated content across our marketing and social media channels.

    2. You represent and warrant that you are the lawful owner of, or have the necessary rights to, any 

    3. content you share, and that such content does not infringe upon the rights, intellectual property, or privacy of any third party.

    4. We reserve the right to remove, hide, or moderate any comments or content deemed offensive, unlawful, defamatory, or misleading at its discretion.

 


 

  1. Limitations of Liability

    1. While we strive to provide our services with the utmost care and diligence, we shall not be held liable for any indirect, incidental, or consequential losses or damages arising from or related to your use of our website or products.

    2. Although we endeavor to maintain the continuous availability, security, and error-free operation of our website, we do not warrant or guarantee that access will be uninterrupted or free from defects. We commit, however, to making reasonable efforts to ensure optimal performance and reliability.

 


 

  1. Legal Housekeeping

    1. These Terms and Conditions are governed by the laws of Victoria, Australia, and Australian Consumer Law.
      Any disputes must be approached in good faith before proceeding with legal action.

    2. If any part of these Terms and Conditions are found invalid, the rest remains in effect.

    3. These Terms and Conditions (along with our Privacy Policy and other linked documents) make up the full agreement between us.
